Autism Spectrum Disorder Insurance Mandate 6 Relief Program.--(a) There is hereby established within the 7 Insurance Department a program to be known as the Insurance 8 Mandate Relief Program. The Insurance Department, in conjunction 9 with the Department of Revenue, shall administer the program. 10 The program shall provide assistance in the form of payments to 11 employers from the calendar year of implementation and every 12 year thereafter. Payments shall be an amount equal to the 13 difference in employer costs of providing insurance from the 14 preceding fiscal year in order to offset increased employer 15 costs of providing autism spectrum disorders coverage as 16 required by this act. 17 (b) An employer who provides and pays for health coverage 18 for employes of the employer is eligible for program assistance. 19 No employer may claim or receive a payment under this section 20 unless that person is in full compliance with State tax laws. 21 (c) The Insurance Department, in conjunction with the 22 Department of Revenue, shall promulgate regulations and adopt 23 procedures necessary to fulfill the requirements of this 24 section, including, but not limited to, the application process, 25 types of payments or credits to be provided, review process, 26 additional eligibility requirements and appeal process. 27 (d) The following shall apply: 28 (1) A person who wilfully submits false or fraudulent 29 information under this section commits a violation of 18 Pa.C.S. 30 § 4904 (relating to unsworn falsification to authorities) and 31 shall, upon conviction, be subject to punishment as provided by 32 law. 33 (2) A person who wilfully divulges or makes known 34 individual-specific information submitted under this section, 35 permits individual-specific information to be seen or examined 36 by any person or prints, publishes or makes known in any manner 37 individual-specific information commits a misdemeanor of the 38 third degree and shall, upon conviction, be sentenced to pay a 39 fine not exceeding two thousand five hundred dollars ($2,500) 40 and the costs of prosecution or to undergo imprisonment for not 41 more than one year, or both.
