Amend Bill, page 1, lines 12 through 16, by striking out all
of said lines and inserting
An anti-obesity drug shall be considered a compensable item
under the medical assistance program when it is included:
(1) in the definition of "covered outpatient drug" under
section 1927(k) of the Social Security Act (49 Stat. 620, 42
U.S.C. § 1396r-8(k)) and subject to section 1927(a)(1) of the
Social Security Act (49 Stat. 620, 42 U.S.C. § 1396r-8(a)(1)) ;
and
(2) on the Pennsylvania Medical Assistance Statewide
Preferred Drug List authorized under section 459.1.
