(3) Beginning July 1, 2021, and each July 1 thereafter,
the department shall automatically increase the tax credit
amount by $5,000,000 if the amount used in the prior fiscal
year is equal to or greater than 90% of the tax credit amount
approved in the prior fiscal year or the amount published by
the Legislative Reference Bureau. The department shall
immediately transmit notice of the increased dollar amounts
to the Legislative Reference Bureau for publication in the
Pennsylvania Bulletin.
