| Subject: | Narcan Handouts by Heroin Dealers |
| We are introducing legislation amending the Crimes Code to add an additional sentence of one year in prison and a $5,000 if a person is caught dealing heroin and found with more than three doses of naloxone. There have been reports nationwide of drug dealers distributing Narcan along with heroin to users. It is obviously important to make Narcan widely available but it should not be used as a marketing tool for dealers who want to increase their chances of a repeat customer. Under our bill, if a person is convicted of violating The Controlled Substance, Drug, Device and Cosmetic Act by selling heroin and the individual was found in possession of more than three doses of naloxone at the time of the violation, a sentence of up to one year in prison and a $5,000 fine will be levied in addition to any other mandatory minimums imposed for other drug offenses. If we are going to make any difference in this epidemic, cutting off the drug supply and punishing those who make financial gains by selling heroin is as crucial as moving addicts into treatment. |
