AN ACT
Amending Title 8 (Boroughs and Incorporated Towns) of the
Pennsylvania Consolidated Statutes, in powers, duties and
rights of appointed officers and employees, further providing
for compensation, hours and days of work and outside
employment and for appointments and incompatible offices.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1104(b) of Title 8 of the Pennsylvania
Consolidated Statutes is amended to read:
Section 1. Sections 1101 and 1104(b) of Title 8 of the
Pennsylvania Consolidated Statutes are amended to read:
§ 1101. Compensation, hours and days of work and outside
employment.
(a) General rule.--Appointed officers and employees of the
borough shall receive compensation for their services as the
council shall prescribe. Council may also establish the hours
and days of work and may restrict the outside employment of
borough employees or any class or category of employment.
(b) Conflict of interest.--Prior to the borough council

determining compensation for its employees, each council member
employed by the borough shall abstain from voting in accordance
with 65 Pa.C.S. § 1103(j) (relating to restricted activities).
§ 1104. Appointments and incompatible offices.

[(b) Prohibition.--
(1) Except as set forth in paragraph (2), no elected
borough official of a borough with a population of 3,000 or
more may serve as an employee of that borough.
(2) Paragraph (1) shall not apply to a borough official
serving as an employee of that borough prior to the
certification of the 2010 official census or a subsequent
latest official census which indicates an increase in the
population of that borough to 3,000 or more.]

Section 2. This act shall take effect in 60 days.
