AN ACT
Providing for crematory regulation.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Crematory
Regulation Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Crematory incinerator." A furnace or apparatus for burning
animal or human remains to bone fragments.
"Department." The Department of Environmental Protection of
the Commonwealth.
Section 3. Emissions criteria.
The operation of a crematory incinerator shall not at any

time result in any of the following emissions:
(1) Particulate matter emissions in excess of 0.08
grains per dry standard cubic feet (gr/dscf), corrected to 7%
oxygen.
(2) Sulfur compound emissions in excess of 500 parts per
million, by volume or dry basis.
(3) Visible air contaminant emissions in a manner in
which the opacity of the emissions is equal to or greater
than:
(i) 10% for a period aggregating more than three
minutes in any one hour; or
(ii) 30% at any time.
(4) Odor emissions in a manner in which the malodors are
detectable outside the property of the person on whose land
the crematory incinerator is being operated.
Section 4 3. Operating requirements.
A crematory incinerator shall operate under the following
requirements:
(1) With respect to charging, either of the following
apply:
(i) Before charging the unit, the temperature at the
exit of the secondary or last chamber shall achieve 1400
degrees Fahrenheit or higher and be maintained throughout
the cremation cycle.
(ii) For units that are charged when both chambers
are cold, the temperature at the exit of the secondary or
last chamber shall achieve and be maintained at or above
1400 degrees Fahrenheit before firing the primary chamber
burner.
(2) The crematory incinerator shall provide an interlock

system that precludes either of the following:
(i) The charging of the primary chamber until the
temperature at the exit of the secondary or last chamber
is established and holding at or above 1400 degrees
Fahrenheit and, after charging, precludes opening the
charge door until the cremation cycle is complete, except
for short periods of time to inspect or reposition the
remains.
(ii) In units that are charged when both chambers
are cold, the firing of the primary chamber burner until
the secondary chamber temperature is established and
holding at or above 1400 degrees Fahrenheit.
(3) The representative or another qualified technician
of the manufacturer shall adjust the burners after the unit
is constructed and before a new unit is first operated and at
other appropriate times such as when the use of an approved
fuel is initiated and when visible emissions are observed.
(1) Gases generated by the combustion in a crematory
incinerator shall be subject to a minimum temperature of 1400
degrees Fahrenheit for a period of not less than one second.
(4) (2) The department shall not require operation of a
crematory incinerator at a temperature greater than specified
in this section.
Section 5. Monitoring.
(a) Requirements.--The temperature at the primary and
secondary or last combustion chamber exit of which a crematory
incinerator is operated shall be continuously monitored and
recorded.
(b) Sensors.--Sensors shall be located in a crematory
incinerator such that flames from the burners do not impinge on

the sensors.
(c) Standard.--Continuous monitoring (b) Standard.--
Monitoring shall be conducted in accordance with rules and
regulations adopted by the department.
Section 6. Applicability.
This act applies to a crematory incinerator for which
construction commenced after April 17, 1989.
Section 7. Effective date.
This act shall take effect in 180 60 days.
