AN ACT
Providing for extension of COVID-19 waiver provisions for
outdoor sportsman clubs. PROVIDING FOR THE DESIGNATION OF
SHOOTING RANGES, SPORTSMAN CLUBS, HUNTING FACILITIES AND
BUSINESS RELATING TO THE SALE AND PRODUCTION OF FIREARMS AND
AMMUNITION AS LIFE-SUSTAINING.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the COVID-19
Emergency Outdoor Sportsman Club Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"COVID-19." The novel coronavirus identified in the
proclamation of disaster emergency issued by the Governor on
March 6, 2020, published at 50 Pa.B. 1644 (March 21, 2020), and

any renewal of the state of disaster emergency.
"Outdoor sportsman club." An association or club where
members and the public gather that has a shooting range.
"Range." An archery range, handgun shooting range, rifle
shooting range or shotgun range.
Section 3. Extension of COVID-19 waiver provisions.
The Secretary of Community and Economic Development shall
immediately issue a waiver to the Governor's 20200319 TWW COVID-
19 Business Closure Order to all outdoor sportsman clubs that
can adhere to the social distancing practices, mask requirements
and other mitigation measures defined by the Centers for Disease
Control and Prevention to protect individuals and to mitigate
the spread of the COVID-19 virus.
Section 4. Effective date.
This act shall take effect immediately.
SECTION 1. SHORT TITLE.
THIS ACT SHALL BE KNOWN AND MAY BE CITED AS THE HUNTING,
FIREARM AND AMMUNITION LIFE-SUSTAINING BUSINESS ACT.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Law enforcement officer." As defined in 42 Pa.C.S. §
5950(d) (relating to confidential communications involving law
enforcement officers).
SECTION 2 3. DESIGNATION OF LIFE-SUSTAINING BUSINESSES.
NOTWITHSTANDING ANY LAW OR REGULATION TO THE CONTRARY,
CONSISTENT WITH THE INVIOLATE RIGHTS ENUMERATED UNDER SECTIONS
21 AND 25 OF ARTICLE I OF THE CONSTITUTION OF PENNSYLVANIA,
SHOOTING RANGES, SPORTSMAN CLUBS, HUNTING FACILITIES AND FIREARM

AND AMMUNITION PRODUCT MANUFACTURERS, RETAILERS, IMPORTERS AND
DISTRIBUTORS, INCLUSIVE OF THEIR EMPLOYEES AND AGENTS, SHALL
ALWAYS BE CONSTITUTED AS LIFE-SUSTAINING BUSINESSES IN THIS
COMMONWEALTH for the purposes of training law enforcement
officers, WHICH SHALL NEVER BE SHUTTERED OR LIMITED IN THEIR
ABILITY TO PRODUCE, PROVIDE, SELL OR OTHERWISE OFFER FIREARMS,
AMMUNITION, FIREARM ACCESSORIES, COMPONENT PARTS OF FIREARMS,
AMMUNITION AND FIREARM ACCESSORIES, AND ALL SERVICES, TRAINING,
SAFETY AND PRACTICE RELATED TO FIREARMS AND HUNTING by law
enforcement officers fulfilling the requirements of their
employment.
Section 4. Compliance with public health requirements.
Nothing in this act shall be construed to relieve a business
permitted to operate under section 2 from adhering to the social
distancing practices, mask requirements and other mitigation
measures defined by the Centers for Disease Control and
Prevention, or for the requirements for businesses to operate as
ordered by the Governor under 35 Pa.C.S. § 7301 (relating to
general authority of Governor).
SECTION 3 5. EFFECTIVE DATE.
THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
