AN ACT
Providing for COVID-19 guidelines EXTENSION OF COVID-19 WAIVER
PROVISIONS for outdoor sportsman clubs. and for hours worked
by employees of outdoor sportsman clubs.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the COVID-19
Emergency Outdoor Sportsman Club Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Clubhouse." An inside area at an outdoor sportsman club
where individuals gather and food and beverages may be served.
"COVID-19." The novel coronavirus identified in the
proclamation of disaster emergency issued by the Governor on
March 6, 2020, published at 50 Pa.B. 1644 (March 21, 2020), and

any renewal of the state of disaster emergency.
"Department." The Department of Health of the Commonwealth.
"Outdoor sportsman club." An association or club where
members and the public gather that has a shooting range.
"Range." An archery range, handgun shooting range, rifle
shooting range or shotgun range.
Section 3. COVID-19 guidelines for outdoor sportsman clubs.
All outdoor sportsman clubs in this Commonwealth that choose
to remain open during the COVID-19 emergency shall:
(1) Impose social distancing and mask requirements in
accordance with the department's COVID-19 guidelines.
(2) Only permit five shooters in each range at a time.
(3) Close a clubhouse associated with the outdoor
sportsman club in order to adhere to the department's COVID-
19 guidelines.
SECTION 3. EXTENSION OF COVID-19 WAIVER PROVISIONS.
THE SECRETARY OF COMMUNITY AND ECONOMIC DEVELOPMENT SHALL
IMMEDIATELY ISSUE A WAIVER TO THE GOVERNOR'S 20200319 TWW COVID-
19 BUSINESS CLOSURE ORDER TO ALL OUTDOOR SPORTSMAN CLUBS THAT
CAN ADHERE TO THE SOCIAL DISTANCING PRACTICES, MASK REQUIREMENTS
AND OTHER MITIGATION MEASURES DEFINED BY THE CENTERS FOR DISEASE
CONTROL AND PREVENTION TO PROTECT INDIVIDUALS AND TO MITIGATE
THE SPREAD OF THE COVID-19 VIRUS.
Section 4. Outdoor sportsman club hours worked.
Notwithstanding any other provision of law, the term "hours
worked" as used in the act of January 17, 1968 (P.L.11, No.5),
known as The Minimum Wage Act of 1968, and departmental
regulation includes time during which an employee of an outdoor
sportsman club is required, by the outdoor sportsman club or by
law, to be on the premises of the outdoor sportsman club for any

of the following:
(1) Undergo a screening.
(2) Change into or remove protective gear.
(3) Any other activity necessary for the employee to
perform duties.
This term also includes any time an employee is required to be
on duty or to be at the prescribed work place, time spent in
traveling as part of the duties of the employee during normal
working hours and time during which an employee is employed or
permitted to work; provided, however, that time allowed for
meals shall be excluded unless the employee is required or
permitted to work during that time, and provided further, that
time spent on the premises of the outdoor sportsman club for the
convenience of the employee shall be excluded.
Section 4 5. Effective date.
This act shall take effect immediately.
