Act of Dec. 28, 1992,P.L. 1694, No. 188 Cl. 86 - CAPITAL BUDGET PROJECT ITEMIZATION ACT OF 1991-1992 - ENACTMENT Statute Update Generated 2015-01-29 09:12:25 AMCAPITAL BUDGET PROJECT ITEMIZATION ACT OF 1991-1992 - ENACTMENTAct of Dec. 28, 1992, P.L. 1694, No. 188Cl. 86 A SUPPLEMENT To the act of August 6, 1991 (P.L.329, No.34), entitled "An act providing for the capital budget for the fiscal year 1991-1992," itemizing public improvement projects, furniture and equipment projects, transportation assistance projects, flood control projects, redevelopment assistance projects and public highway projects to be constructed or acquired or assisted by the Department of General Services, the Department of Environmental Resources, the Department of Community Affairs, the Department of Transportation or the Pennsylvania Fish and Boat Commission, together with their estimated financial costs; authorizing the incurring of debt without the approval of the electors for the purpose of financing the projects to be constructed or acquired or assisted by the Department of General Services, the Department of Environmental Resources, the Department of Community Affairs or the Department of Transportation; stating the estimated useful life of the projects; authorizing certain waivers and exemptions; making appropriations; and making repeals. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Short title.This act shall be known and may be cited as the Capital Budget Project Itemization Act of 1991-1992. Section 2. Total authorizations.(a) Public improvements.--The total authorization for the additional capital projects in the category of public improvement projects itemized in section 3 and to be acquired or constructed by the Department of General Services, its successors or assigns and to be financed by the incurring of debt shall be $1,331,282,000.(b) Furniture and equipment.--The total authorization for the additional capital projects in the category of public improvement projects consisting of the acquisition of original movable furniture and equipment to complete public improvement projects itemized in section 4 and to be acquired or constructed by the Department of General Services, its successors or assigns and to be financed by the incurring of debt shall be $45,364,000.(c) Transportation assistance.--The total authorization for the capital projects in the category of transportation assistance projects itemized in section 5 with respect to which an interest is to be acquired in or constructed by the Department of Transportation, its successors or assigns and to be financed by the incurring of debt shall be $360,950,000.(d) Flood control.--The total authorization for the capital projects in the category of flood control projects itemized in section 6 and to be constructed by the Department of Environmental Resources, its successors or assigns and to be financed by the incurring of debt shall be $4,612,000.(e) Redevelopment assistance.--The total authorization for the additional capital projects in the category of redevelopment assistance projects itemized in section 7 for capital grants by the Department of Community Affairs, its successors or assigns and to be financed by the incurring of debt shall be $216,253,000.(f) Public Highways.--The total authorization for the capital projects in the category of highway projects itemized in section 8 and to be constructed by the Department of Transportation, its successors or assigns and to be financed from current revenues of the Motor License Fund shall be $1,458,206,000.(g) Fish Fund and Boat Fund projects.--The total authorizations for the capital projects in the category of public improvement projects itemized in section 9 to be acquired or developed by the Pennsylvania Fish and Boat Commission and to be financed from current revenues of the Boat Fund and the Fish Fund pursuant to executive authorizations shall be $4,500,000.(h) Fish Fund and Boat Fund furniture and equipment.--The total authorizations for the capital projects in the category of furniture and equipment projects itemized in section 10 to be acquired or developed by the Pennsylvania Fish and Boat Commission and to be financed from current revenues of the Boat Fund and the Fish Fund pursuant to executive authorizations shall be $200,000. Compiler's Note: The Department of Environmental Resources, referred to in this section, was abolished by Act 18 of 1995. Its functions were transferred to the Department of Conservation and Natural Resources and the Department of Environmental Protection.Section 3. Pennsylvania Fish and Boat Commission authorization.The Pennsylvania Fish and Boat Commission is authorized, subject to executive approval and authorization, to construct the facility itemized in section 9 by contract awarded by the Department of General Services or to acquire the facility by means of a lease with an option to purchase. If the commission elects the lease/purchase option, it will advertise for proposals and will award the contract based on the best interests of this Commonwealth to a responsive and responsible proposer. Section 12. Debt authorization.(a) Public improvements.--The Governor, Auditor General and State Treasurer are hereby authorized and directed to borrow, from time to time, in addition to any authorization heretofore or hereafter enacted, on the credit of the Commonwealth, subject to the limitations provided in the current capital budget, money not exceeding in the aggregate the sum of $1,331,282,000 as may be found necessary to carry out the acquisition and construction of the public improvement projects specifically itemized in a capital budget.(b) Furniture and equipment.--The Governor, Auditor General and State Treasurer are hereby authorized and directed to borrow, from time to time, in addition to any authorization heretofore or hereafter enacted, on the credit of the Commonwealth, subject to the limitations provided in the current capital budget, money not exceeding in the aggregate the sum of $45,364,000 as may be found necessary to carry out the public improvement projects consisting of the acquisition of original movable furniture and equipment specifically itemized in a capital budget.(c) Transportation assistance.--The Governor, Auditor General and State Treasurer are hereby authorized and directed to borrow, from time to time, in addition to any authorization heretofore or hereafter enacted, on the credit of the Commonwealth, subject to the limitations provided in the current capital budget, money not exceeding in the aggregate the sum of $360,950,000 as may be found necessary to carry out the acquisition and construction of the transportation assistance projects specifically itemized in a capital budget.(d) Flood control.--The Governor, Auditor General and State Treasurer are hereby authorized and directed to borrow, from time to time, in addition to any authorization heretofore or hereafter enacted, on the credit of the Commonwealth, subject to the limitations provided in the current capital budget, money not exceeding in the aggregate the sum of $4,612,000 as may be found necessary to carry out the construction of the flood control projects specifically itemized in a capital budget.(e) Redevelopment assistance.--Subject to the limitation in section 1616.1-B(b) of the act of April 9, 1929 (P.L.343, No.176), known as The Fiscal Code, the Governor, Auditor General and State Treasurer are hereby authorized and directed to borrow, from time to time, in addition to any authorization heretofore or hereafter enacted, on the credit of the Commonwealth, subject to the limitations provided in the current capital budget, money not exceeding in the aggregate the sum of $216,253,000 as may be found necessary to carry out the redevelopment assistance projects specifically itemized in a capital budget. Section 13. Issue of bonds.The indebtedness authorized in this act shall be incurred, from time to time, and shall be evidenced by one or more series of general obligation bonds of the Commonwealth in such aggregate principal amount for each series as the Governor, Auditor General and State Treasurer shall determine, but the latest stated maturity date shall not exceed the estimated useful life of the projects being financed as stated in section 14. Section 14. Estimated useful life and term of debt.(a) Estimated useful life.--The General Assembly states that the estimated useful life of the public improvement projects itemized in this act is as follows:(1) Public improvement projects, 30 years.(2) Furniture and equipment projects, 10 years.(3) Transportation assistance projects:(i) Rolling stock, 15 years.(ii) Passenger buses, 12 years.(iii) Furniture and equipment, 10 years.(iv) All others, 30 years.(b) Term of debt.--The maximum term of the debt authorized to be incurred under this act is 30 years. Section 15. Appropriations.(a) Public improvements.--The net proceeds of the sale of the obligations authorized in this act are hereby appropriated from the Capital Facilities Fund to the Department of General Services in the maximum amount of $1,331,282,000 to be used by it exclusively to defray the financial cost of the public improvement projects specifically itemized in a capital budget. After reserving or paying the expenses of the sale of the obligation, the State Treasurer shall pay to the Department of General Services the moneys as required and certified by it to be legally due and payable.(b) Furniture and equipment.--The net proceeds of the sale of the obligations authorized in this act are hereby appropriated from the Capital Facilities Fund to the Department of General Services in the maximum amount of $45,364,000 to be used by it exclusively to defray the financial cost of the public improvement projects consisting of the acquisition of original movable furniture and equipment specifically itemized in a capital budget. After reserving or paying the expenses of the sale of the obligation, the State Treasurer shall pay to the Department of General Services the moneys as required and certified by it to be legally due and payable.(c) Transportation assistance.--The net proceeds of the sale of the obligations authorized in this act are hereby appropriated from the Capital Facilities Fund to the Department of Transportation in the maximum amount of $360,950,000 to be used by it exclusively to defray the financial cost of the transportation assistance projects specifically itemized in a capital budget. After reserving or paying the expenses of the sale of the obligation, the State Treasurer shall pay to the Department of Environmental Resources the moneys as required and certified by it to be legally due and payable.(e) Redevelopment assistance.--The net proceeds of the sale of the obligations authorized in this act are hereby appropriated from the Capital Facilities Fund to the Department of Community Affairs in the maximum amount of $216,253,000 to be used by it exclusively to defray the financial cost of the redevelopment assistance projects specifically itemized in a capital budget. After reserving or paying the expenses of the sale of the obligation, the State Treasurer shall pay to the Department of Community Affairs the moneys as required and certified by it to be legally due and payable. Section 16. Federal funds.In addition to those funds appropriated in section 15, all moneys received from the Federal Government for the projects specifically itemized in this act are also hereby appropriated for those projects. Section 17. Limited waiver of local requirements.The limitation on Department of Transportation funding of capital projects under 74 Pa.C.S. § 1302(4) (relating to program authorizations) shall be waived for the capital projects in the category of transportation assistance projects for mass transit contained in section 5(b)(10)(x), (xi), (xii) and (xiii), (13)(i), (xix), (xx), (xxi), (xxii) and (xxiii) and (16) of this act. Section 18. Allocation of funds.Whenever as determined by the Department of Transportation that the full estimated financial costs of the projects itemized in section 8 are not necessary for the proper design, acquisition or construction of such projects, the excess funds no longer required may be allocated by the Pennsylvania Department of Transportation to increase the estimated costs of any one or more of the projects specifically itemized in a capital budget. Section 19. Expenditure adjustment.All funds expended or encumbered for public improvement projects itemized in section 3(13)(xxi) of the act of October 21, 1988 (P.L.851, No.113), known as the Capital Budget Project Itemization Act for 1987-1988, shall be credited against the projects set forth in section 3(12)(vi) of this act. Section 20. Delegation of public improvement projects.(a) General delegation.--For the public improvement projects specifically itemized in section 3(12)(vi), the Department of General Services may delegate the authority to construct, improve, equip, furnish, maintain, acquire or operate the project to the Philadelphia Regional Port Authority.(b) Specific delegation.--(1) General Assembly finds that it is in the interest of the preservation of employment and the expansion of business opportunities in this Commonwealth, as well as the general welfare of the people of this Commonwealth, that a new paper warehouse at adjacent Piers 78-80 in the Port of Philadelphia, as itemized in section 3(12)(vi)(A), be constructed without any additional delay and that the sole authority to construct the paper warehouse be vested in the Philadelphia Regional Port Authority.(2) Authority to construct, improve, equip, furnish, maintain, acquire or operate the new paper warehouse itemized in section 3(12)(vi)(A) is hereby removed from the Department of General Services. The Department of General Services shall immediately cease any activity with respect to the construction, improvement, equipping, furnishing, maintenance, acquisition or operation of the paper warehouse. The authority of the Department of General Services with respect to the paper warehouse shall be limited to approval of payment under this act and insurance of compliance by the Philadelphia Regional Port Authority with the Commonwealth's capital budget implementation process, as it shall be amended from time to time.(3) Notwithstanding any other provision of this act or any other statute, authority to construct, improve, equip, furnish, maintain, acquire and operate the new paper warehouse itemized in section 3(12)(vi)(A) is hereby vested in the Philadelphia Regional Port Authority and the authority is hereby directed to proceed immediately to competitively bid and construct the paper warehouse as a new project in accordance with section 11 of the act of July 10, 1989 (P.L.291, No.50), known as the Philadelphia Regional Port Authority Act.(4) Participation in the bidding process authorized under paragraph (3) shall be the sole remedy for any person previously involved in the bidding process before the Department of General Services and no suit or other proceeding shall be brought before any court or administrative body against the Commonwealth or any agency, officer or employee thereof as a result of any action taken or contract heretofore awarded with respect to the paper warehouse project, except to the extent that a remedy is available before the Board of Claims under the act of May 20, 1937 (P.L.728, No.193), referred to as the Board of Claims Act. Section 21. Conrail, CSX and Canadian Pacific/Delaware and Hudson restrictions.The Conrail, CSX and Canadian Pacific/Delaware and Hudson projects shall be subject to the following restrictions:(1) As a condition of the Commonwealth's participation in the capital project authorized under section 5(a)(1)(i)(A) and (ix)(A), the Commonwealth's expenditure shall not exceed 30% of the total cost of the project, and the remaining cost of the project shall be the responsibility of Conrail, its assigns or successors.(2) As a condition of the Commonwealth's participation in the capital project authorized under section 5(a)(1)(ii)(A), the Commonwealth's expenditure shall not exceed 30% of the total cost of the project, and the remaining cost of the project shall be the responsibility of Canadian Pacific/Delaware and Hudson, their assigns and successors.(3) As a condition of the Commonwealth's participation in the capital project authorized under section 5(a)(1)(iii)(A), the Commonwealth's expenditure shall not exceed 30% of the total cost of the project, and the remaining cost of the project shall be divided equally between Conrail, its assigns or successors and Canadian Pacific/Delaware and Hudson, their assigns and successors.(4) As a condition of the Commonwealth's participation in the capital projects authorized under section 5(a)(1)(xi)(A) and (xii)(A), the Commonwealth's expenditure shall not exceed 30% of the total cost of the project, and the remaining cost of the project shall be the responsibility of CSX, its assigns and successors.(5) The base project allocation of $1,080,000 authorized in section 5(a)(1)(x)(A) is the estimated total cost of the horizontal clearance improvements between Wilkes-Barre and the Greenwich Yard. The actual amount of the Commonwealth's expenditure for these horizontal clearance improvements will be negotiated between the Commonwealth and the various entities which wish to see these improvements made and are willing to participate financially in the project. Conrail and Canadian Pacific/Delaware and Hudson and their successors and assigns will not participate financially in the costs of the horizontal clearance improvements.(6) As a precondition of the Commonwealth's participation in the capital projects authorized under section 5(a)(1)(vi)(A) and (vii)(A), the Secretary of Transportation must certify that all railroads serving the ports of Philadelphia have negotiated reasonable rates and terms with each other for a period of not less than seven years to insure competitive access for these railroads to transport any port cargo, including cargo being transported through the Tioga Marine Terminal. Section 22. Correctional facilities.Capital projects in the category of public improvement projects specifically itemized for the Department of Corrections in section 3(1) of the act of December 20, 1990 (P.L.1472, No.223), known as the Capital Budget Project Itemization Act for 1990-1991, are hereby authorized to be constructed or acquired by the Department of General Services, its successors or assigns, notwithstanding any zoning ordinance, land use ordinance, building code or other regulation adopted or enacted by a political subdivision under the authority of any statute or under the authority of any home rule charter authorized and adopted under any statute or the Constitution of Pennsylvania. Section 23. Restricted release of funding.No projects authorized under section 7(8)(i)(A) through (E) and (G) through (O) shall receive any State funds under this act until the development and implementation of a training program to assist with the training and development of individuals in the arts and entertainment industry. Section 24. Delegation of public improvement projects.For the public improvement projects specifically itemized in section 3(11), the Department of General Services may delegate the authority to construct, improve, equip, furnish, maintain, acquire or operate the projects to the State System of Higher Education. Section 25. Applicability.Section 22 shall be retroactive to December 20, 1990. Section 26. Repeals.The following acts and parts of acts are repealed:Section 3(10)(iv) of the act of July 10, 1986 (P.L.1285, No.118), known as the Capital Budget Project Itemization Act for 1984-1985.Section 3(13)(iii)(A), (xvii)(A) and (xx)(A) of the act of October 21, 1988 (P.L.851, No.113), known as the Capital Budget Project Itemization Act for 1987-1988. Section 27. Editorial changes.In editing and preparing this act for printing following the final enactment, the Legislative Reference Bureau shall insert or revise letters or numbers for projects where the letters or numbers are missing or require revision. The Legislative Reference Bureau shall also revise the total monetary amounts for the total authorization, debt authorization, appropriations and departmental totals as necessary to agree with the total monetary amounts of the projects. Section 28. Effective date.This act shall take effect immediately.
