The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:Section 1. It is the purpose of this act to encourage the return to operation and productivity of an aluminum extrusion facility and to remove impediments to the financing of the facility. A portion of the West Branch of the Schuylkill River, navigable river, lies within certain lands in the Borough of Cressona, and the Township of North Manheim, Schuylkill County, Pennsylvania, now or formerly owned by Aluminum Company of America. To enable the expansion of the aluminum extrusion facility now or formerly owned and operated in Cressona by Aluminum Company of America, the bed of said river was relocated pursuant to a permit issued on August 11, 1942 by the Water and Power Resources Board of the Department of Forests and Waters of the Commonwealth of Pennsylvania. Pursuant to law, the Commonwealth of Pennsylvania retains fee simple title in and to the tract of land lying within the abandoned riverbed. Therefore, the Commonwealth of Pennsylvania should convey its right, title and interest in the tract of land formerly within the bed of said river, to Aluminum Company of America or such other party as shall own the lands adjacent to said tract on the date of the conveyance.Section 2. The Department of General Services, acting on behalf of the Commonwealth of Pennsylvania with the approval of the Secretary of Environmental Resources, is hereby authorized to convey, in consideration of $1, all the right, title and interest of the Commonwealth of Pennsylvania in and to that tract of land, as hereinafter described, in the Borough of Cressona, and the Township of North Manheim, Schuylkill County, Pennsylvania, except for that portion of the land which forms the present bed of the West Branch of the Schuylkill River, resulting from the relocation of said riverbed pursuant to a permit issued on August 11, 1942 by the Water and Power Resources Board of the Department of Forests and Waters of the Commonwealth of Pennsylvania.The Deed of Conveyance shall name as grantee the owner, as of the date of the conveyance authorized hereby, of certain lands in the Borough of Cressona and the Township of North Manheim, now or formerly owned by Aluminum Company of America, within which lands lies the tract to be conveyed. Said lands are described as follows:Tract No. 1All that certain tract or parcel of land situate in the Borough of Cressona, Schuylkill County, Pennsylvania, bounded and described in accordance with a survey prepared by George H. The Deed of Conveyance shall be approved by the Department of Justice and shall be executed by the Department of General Services, with the concurrence of the Secretary of Environmental Resources, in the name of the Commonwealth of Pennsylvania.
