EASEMENT - CONSTRUCTION OF SHEET PILE CELL IN OHIO RIVER Act of Jul. 1, 1978, P.L. 588, No. 110 Cl. 85 AN ACT Authorizing the Department of Environmental Resources to grant an easement to the Buckeye Pipeline Company to construct, use, renew, maintain and repair a sheet pile cell in the Ohio River in Moon Township, Allegheny County. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. The Department of Environmental Resources is hereby authorized to grant to the Buckeye Pipeline Company, its successors and assigns, an easement to construct, use, renew, maintain and repair a sheet pile cell in the Ohio River, Moon Township, Allegheny County, such easement being more particularly described as follows: Beginning at the southerly corner of lands of Buckeye Pipeline Company (formerly Burrell Construction and Supply) on the northwesterly line of lands of B.P. Oil Company, Inc.; thence along the line of Buckeye Pipeline Company, north 33 degrees 28 minutes 38 seconds east 995.35 feet to a point, said point being south 60 degrees 49 minutes 57 seconds east 30.54 feet from the corner of an existing dock, and on a line extended from the face of said existing dock; thence by the line extended from the face of existing dock, through lands now or formerly of B.P. Oil Company, Inc., south 60 degrees 49 minutes 57 seconds east 92.46 feet to a point 123.00 feet from, and in line with the face of the above mentioned existing dock, said point being the true point of beginning for the easement herein described; thence north 29 degrees 10 minutes 03 seconds east, 2.00 feet; thence south 60 degrees 49 minutes 57 seconds east, 10.00 feet; thence south 29 degrees 10 minutes 03 seconds west, 10.00 feet; thence north 60 degrees 49 minutes 57 seconds west, 10.00 feet; thence north 29 degrees 10 minutes 03 seconds east, 8.00 feet to the place of beginning for the easement herein described. Said easement for construction of a sheet pile cell being 10 feet square and containing an area of 100.00 square feet. Compiler's Note: The Department of Environmental Resources, referred to in this section, was abolished by Act 18 of 1995. Its functions were transferred to the Department of Conservation and Natural Resources and the Department of Environmental Protection. Section 2. This act shall take effect immediately. |
