The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:Section 1. The Department of Property and Supplies, with the approval of the Governor, is hereby authorized on behalf of the Commonwealth of Pennsylvania, to convey to the Carbondale Redevelopment Authority for a consideration of one dollar ($1), the following described tract of land situate in the City of Carbondale, County of Lackawanna, Commonwealth of Pennsylvania, bounded and described as follows:Beginning at a point on the southerly side of Eighth Avenue in line of lands formerly of Thomas Wyllie, now owned by John T. Loftus and running thence south along said line 150 feet to line of land of Henry Sahm now owned by the Klotz Throwing Company 36 feet to line of land late of George H. Moon now owned by said Klotz Throwing Company, thence northerly along line of lands of the said Klotz Throwing Company 150 feet to the southerly line of Eighth Avenue; thence eastwardly along said line of Eighth Avenue 36 feet to place of beginning, containing 5400 square feet.Also beginning at a corner of Eighth Avenue, and lot formerly of Henry Sahm; thence south 10 degrees thirty minutes west 150 feet to a corner of land now or late of John Moon; thence north 10 degrees thirty minutes east 150 feet to said Eighth Avenue; thence south 79 degrees thirty minutes east 50 feet to place of beginning, containing 7500 square feet.Being lands acquired by the Commonwealth by deed of October 21, 1921 and recorded on April 7, 1922 in the Recorder's Office of Lackawanna County in Deed Book 319, page 308.The conveyance shall be made under and subject to all easements, servitudes and rights of others, including but not confined to streets, roadways, and rights of any telephone, telegraph, water, electric, gas or pipeline companies, as well as under and subject to any estates or tenancies vested in third persons, whether or not appearing of record, for any portion of the land or improvements erected thereon.Section 2. (2 repealed Jul. 9, 1976, P.L.990, No.200)Section 3. The deed of conveyance shall be approved by the Department of Justice and shall be executed by the Secretary of Property and Supplies in the name of the Commonwealth of Pennsylvania.Section 4. This act shall take effect immediately.
