CONVEYANCE - COMMONWEALTH PROPERTY IN FRANKLIN COUNTY TO GREEN TOWNSHIP Act of Jul. 3, 1974, P.L. 454, No. 158 Cl. 85 AN ACT Authorizing the Department of Property and Supplies, with the approval of the Governor and the Secretary of Environmental Resources, to sell and convey to Greene Township, Franklin County, Pennsylvania a portion of the Irishtown Plantation Road, in Greene Township, Franklin County, Pennsylvania. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. The Department of Property and Supplies, with the approval of the Governor and the Secretary of Environmental Resources, is hereby authorized to convey to Greene Township, Franklin County, Pennsylvania, its successors and assigns for a consideration of one dollar ($1), fee simple title to the following described portion of Irishtown Plantation Road in said township and county, bounded and described as follows: Beginning at the intersection of the Irishtown Plantation Road with Township Road T-666, said point being about one-half mile south of Pennsylvania Route 30, on T-666 and Section Number 118+27 on the Irishtown Plantation Road; thence in a southerly direction for about 2,667 feet to Station Number 91+60 on the Irishtown Plantation Road, said station being at the center of the road leading to the Mount Cydonia Sand Company, said road being on the east side of the Irishtown Plantation Road. Said section of the Irishtown Plantation Road is entirely or partially on State forest land and does not exceed a width of 33 feet on State forest land. The conveyance shall be made under and subject, nevertheless, to all easements, servitudes and rights of others, including but not confined to streets, roadways and rights of any telephone, telegraph, water, electric, gas, sewer or pipeline companies as well as under and subject, nevertheless, to any estate or tenancies vested in third persons, whether or not appearing of record, for any portion of the said land or improvements erected thereon. Title to the property conveyed shall revert to the Commonwealth of Pennsylvania whenever the property ceases to be used for public purposes. Compiler's Note: The Secretary of Environmental Resources, referred to in this section, was abolished by Act 18 of 1995. The functions of the secretary were transferred to the Secretary of Conservation and Natural Resources and the Secretary of Environmental Protection. Section 2. The deed of conveyance shall be approved by the Department of Justice and shall be executed by the Department of Property and Supplies, with the concurrence of the Secretary of Environmental Resources, in the name of the Commonwealth of Pennsylvania. Compiler's Note: The Secretary of Environmental Resources, referred to in this section, was abolished by Act 18 of 1995. The functions of the secretary were transferred to the Secretary of Conservation and Natural Resources and the Secretary of Environmental Protection. Section 3. This act shall take effect immediately. |
