PROJECT 7O LAND ACQUISITION AND BORROWING ACT - LAND CONVEYANCE Act of Jun. 27, 1974, P.L. 404, No. 140 Cl. 85 AN ACT Authorizing the Department of Property and Supplies with the approval of the Pennsylvania Historical and Museum Commission and the Governor, to transfer certain project 70 lands in Manheim Township, Lancaster County to the trustees of the Landis Valley Mennonite Church in exchange for another tract of land therein situate. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Pursuant to the requirements of subsection (b) of section 20, act of June 22, 1964 (Sp. Sess., P.L.131, No.8), known as the "Project 70 Land Acquisition and Borrowing Act," the General Assembly authorizes the Department of Property and Supplies, with the approval of the Pennsylvania Historical and Museum Commission and the Governor, to transfer the hereinafter described land in Manheim Township, Lancaster County, Pennsylvania to the trustees of the Landis Valley Mennonite Church in exchange for a grant and conveyance to the Commonwealth of Pennsylvania and its assigns of a tract of land as hereinafter described. Such land shall be free of the restrictions on use and alienation prescribed by section 20, act of June 22, 1964 (Sp. Sess., P.L.131, No.8), known as the "Project 70 Land Acquisition and Borrowing Act" upon: (1) Completion of the exchange transfer to the Commonwealth as hereinafter in this act provided; and (2) Execution and filing of a document of transfer and release, citing the exchange and release of said land from the restrictions on use and alienation prescribed by subsection (b) of section 20 of said act. The document of transfer and release shall upon completion of such exchange transfer be prepared by the Department of Justice and filed in the office of the Recorder of Deeds of Lancaster County. Compliance with this section constitutes the express approval of the General Assembly of release of the restrictions on use and alienation of lands transferred by the Commonwealth hereunder required by subsection (b) of section 20 of such "Project 70 Land Acquisition and Borrowing Act." Section 2. (a) The land to be transferred by the Department of Property and Supplies with the approval of the Pennsylvania Historical and Museum Commission and the Governor to the trustees of the Landis Valley Mennonite Church in Manheim Township, Lancaster County, Pennsylvania is more particularly described as follows: Beginning at a point in the middle of Kissel Hill Road, said point being north 39 degrees 3 minutes 30 seconds east, 128.18 feet from the intersection of said Kissel Hill Road and the Oregon Pike; thence by lands now or formerly of John B. Landis north 10 degrees 45 minutes 40 seconds east, 771.85 feet to a point; thence by lands of the Commonwealth of Pennsylvania (Pennsylvania Farm Museum) south 50 degrees 56 minutes 30 seconds east, 364.70 feet to a point in the middle of Kissel Hill Road; thence along the middle of said Kissel Hill Road and lands of the Commonwealth of Pennsylvania south 38 degrees 24 minutes west, 103.53 feet to a point in the middle of said Kissel Hill Road, thence by the same south 39 degrees 3 minutes 30 seconds west, 576.09 feet to the place of beginning. Containing 2.85 acres more or less. Being a part of the same land acquired by eminent domain proceedings commenced and completed by the Commonwealth of Pennsylvania at Number 11, April Term, 1969, in the Court of Common Pleas of Lancaster County, Pennsylvania. (b) The conveyance shall be made free of all restrictions including the Project 70 restrictions on use and alienation released under this act except other existing restrictions of record if any and as follows: (1) The tract of land shall be used only for cemetery purposes. (2) No third party shall have any rights in the tract of land. (3) The tract of land may, prior to its use for burials, be used for agricultural purposes. (4) Improvements, other than those for burial purposes, on the surface of said tract of land shall be made only with the approval of the Pennsylvania Historical and Museum Commission and the Governor. (c) Title to the property conveyed shall revert to the Commonwealth when the grantee, the trustees of the Landis Valley Mennonite Church ceases to use it for cemetery purposes except for such prior agricultural use authorized. Section 3. The transfer hereinbefore authorized shall be made in exchange for a grant and conveyance to the Commonwealth of Pennsylvania and its assigns of a tract of land hereinafter in this section described, and the Department of Property and Supplies is hereby authorized and empowered to accept on behalf of the Commonwealth of Pennsylvania, by deed from the trustees of the Landis Valley Mennonite Church, the tract of land in Manheim Township, Lancaster County, Pennsylvania, more particularly described as follows: Beginning at a point in the public road leading from Neffsville to the Landis Valley Mennonite Church, said point being located 20 feet westward from a sand stone in the east side of the road; thence extending along in the road, north 33 degrees and 50 minutes west, 119.86 feet to a point in the road; thence by lands of the Commonwealth of Pennsylvania (Pennsylvania Farm Museum) south 77 degrees east, 482.14 feet to an iron pin; thence by lands of the same south 13 degrees and 51 minutes west, 82 feet to an iron pin; thence by lands of the same south 77 degrees east, 150.17 feet to a pin in the middle of Kissel Hill Road; thence extending in the road and by lands of the Commonwealth of Pennsylvania, south 25 degrees 3 minutes west, 31.35 feet to a point in the middle of said Kissel Hill Road; thence along lands of the Landis Valley Mennonite Church, north 64 degrees 57 minutes west, 146.86 feet to an iron pin; thence along lands of said Landis Valley Mennonite Church north 77 degrees west 393.5 feet to the place of beginning. Containing 0.883 acres more or less. Being all of the premises which Henry H. Landis and Mary R. Landis, his wife, by deed dated May 3, 1945 and recorded in the office of the Recorder of Deeds in and for Lancaster County, Pennsylvania, in Deed Book I, No. 37, Page 22, granted and conveyed to Charles B. Landis, John L. Landis and Harry L. Hess, Trustees of Landis Valley Mennonite Church and a portion of the premises which Isaac S. Landis, et. ux., by deed dated May 5, 1927 and recorded in the office of the Recorder of Deeds in and for Lancaster County, Pennsylvania, in Deed Book M., Vol. 28, Page 197, granted and conveyed to Charles B. Landis, Henry L. Heller and Christian Snyder, trustees of the Mennonite Congregation at Landis Valley. Section 4. This act shall take effect immediately. |
