Subject: Ensuring Competition in UCC Enforcement
 
In the near future, I will be reintroducing Senate Bill 406 from the previous session. This legislation proposes an amendment to the Pennsylvania Construction Code Act, aimed at enhancing fairness and choice for property owners in municipalities that enforce the Uniform Construction Code (UCC) through third-party agencies.
 
Currently, over 90% of Pennsylvania's 2,560 municipalities have opted to administer and enforce the UCC locally, either through their employees, joint administration, or certified third-party agencies. Among these municipalities, it is estimated that about 60% rely on third-party agencies, with many contracting exclusively with a single provider. This lack of competition can create challenges for property owners who seek alternatives in services.
 
The proposed legislation would require municipalities utilizing third-party agencies for UCC enforcement to contract with at least two certified agencies, ensuring property owners have a choice. Additionally, the legislation provides a waiver option for very rural municipalities that can demonstrate they are unable to contract with a second agency.
 
This common-sense reform is designed to benefit property owners by promoting competition, improving service quality, and providing alternatives for the review of construction documents and inspection services.
