Subject: | Allowing Municipalities to Back Out of a Merger |
In the near future, I plan to introduce legislation allowing a municipality undergoing a merger to back out of the merger. In 2021, Sandy Township and the City of DuBois passed a referendum consolidating the two municipalities. However, DuBois’ longtime city manager and an employee have since been indicted for allegedly stealing hundreds of thousands of dollars in city funds. As a result of the investigation, concerns have been raised regarding city pension obligations and other ongoing contractual obligations. This led to the Township of Sandy to file a complaint asking for a stay of the merger. The situation in my former Senate District is an unprecedented one, and therefore, there is no legal guidance for a township seeking to back out of a merger. This legislation would provide a much-needed framework and allow Sandy Township to pass another referendum and back out of the consolidation.
