Subject: | Non-Compete Provisions in Broadcast Contracts |
In the near future I plan to re-introduce legislation that would prohibit non-compete provisions in broadcast contracts in Pennsylvania. This legislation was Senate Bill 320 last session. Personal service contracts in the broadcasting industry often include language that limits or prohibits radio, television and other media employees from changing jobs at the conclusion of their contract. These clauses often force employees to choose between a lower paying job to stay with their current employer or moving outside of the area they are currently working to further their career. This legislation would bar broadcast contracts from restricting the movement of a broadcast employee to a new employer or from performing services to an employer within a geographic area at the conclusion of a contract. This would allow individuals who wish to remain in a geographic area where they and their family may have roots to seek the best opportunity available. This legislation does not alter the agreed to, contractual requirements between employers and broadcast employees while the contract is in effect. It also does not prohibit contractual requirements to protect confidential information or trade secrets should the employee take a job with a new employer.
