Senate of Pennsylvania
Session of 2023 - 2024 Regular Session

MEMORANDUM

Posted: December 2, 2022 04:50 PM
From: Senator Judy Ward
To: All Senate members
Subject: Wine & Spirits Auction Permit for Private and Nonpublic Schools

I am reintroducing Senate Bill 193 of last session. This legislation amends the Liquor Code by expanding the list of entities that can receive a wine and spirits auction permit.

Under the current law, various organizations (i.e., any nonprofit hospital, any hospice, institution of higher education) may apply to the Pennsylvania Liquor Control Board to receive a wine and spirits auction permit. Upon payment of a fee of $30 per day, the permit is good for a period of not more than four consecutive or nonconsecutive days in a calendar year. The permittee would be authorized to sell, by auction, wine and spirits by the bottle or case to any person on any day for which the permit is issued. Wine and spirits auction permits are only issued for use at an event which is used by the permittee as a means of raising funds for its operation.

My legislation would amend the list of organizations eligible to receive a wine and spirits auction permit to include any private academic school licensed with the Pennsylvania Department of Education (PDE) and any nonpublic, unlicensed school registered with the PDE.
