Senate of Pennsylvania
Session of 2023 - 2024 Regular Session

MEMORANDUM

Posted: December 2, 2022 11:26 AM
From: Senator Katie J. Muth and Sen. Maria Collett
To: All Senate members
Subject: No Pelvic, Rectal, or Prostate Exams Without Consent

In the near future, we will be re-introducing last session's SB 815, similar legislation to that of Representatives Fiedler and Hanbidge that would prohibit pelvic, rectal, and prostate exams without explicit consent of the patient.

Right now, patients who walk into the hospital for a procedure may not be aware of what happens while they are under anesthesia. As was recently reported, currently medical students may perform a pelvic, rectal, or prostate exams on a patient who is under anesthesia for another surgical procedure. The patient often has not given consent and may be entirely unaware of what is being done to their body while under anesthesia. We must protect patients' rights. We plan to introduce legislation to ensure medical schools, teaching hospitals, and medical institutions receive patient consent for all procedures and exams performed under anesthesia by medical students or for training purposes.

This medical problem was brought to our attention by a concerned constituent who worried what had been done to her body while she was under anesthesia for a different surgery.

Previous cosponsors include Senators Phillips-Hill, Street, Santarsiero, Cappelletti, Tartaglione, Brewster, Costa, Schwank, Kane, Haywood, and Comitta.

Please consider supporting patients by cosponsoring this legislation.

Introduced as SB549
