MEMORANDUM

Subject: Continuity in State Government
 
Few things are more important than having clear and concise statutes that govern the continuity of our state government when one of our leaders becomes incapacitated.
 
At a State Government Committee public hearing in July, we heard from several experts that our law, the Governor and Lieutenant Governor Disability Procedure Law (Act 347 of 1974), is in dire need of an update.
 
As such, I will soon introduce legislation to modernize this act.    The legislation will accomplish the following.
 
  1. Require that both the Governor and the Lieutenant Governor, in addition to communicating with the General Assembly when one of them becomes incapacitated, also communicate with each other.
  2. Remove references to “disability” and replace them with “incapacitation”
  3. Update the means by which communication can be achieved by deleting references to the telegram while adding email or facsimile.
 
After almost 50 years, it is crucial that we modernize this important act.   Please join me in co-sponsoring this legislation.
