Subject: Constitutional Amendment Regarding the Statute of Limitations and Childhood Sexual Abuse
 
A significant carryover commitment as we move into the new legislative session is giving second round approval to a proposed constitutional amendment granting abuse victims a fresh avenue for pursuing justice.  After many years of debate on the issue, a notorious bureaucratic failure stopped a previous effort toward a ballot question.  Now justice advocates and voters are expecting our timely action on the renewed effort.
 
There is a very tight timeline for our action qualifying the question for the primary ballot.  This is due to the 90-day advertising period that is constitutionally prescribed and reenforced by a number of court rulings over the years.  The public purpose is to notify voters of the decision before them, thus giving them the chance to learn about the implications of approving or disapproving the question.
 
As a reminder, this does not present any legislative opportunity for reopening policy debates or revising the language in the proposed amendment.  The wording for second round approval must be identical to that contained in the first-round approval during the recently concluded legislative session.
