Subject: Guardianship Language in Driver's Manual
 
I am introducing legislation that will insert language in the PennDOT Driver’s Manual and PennDOT Motorcycle Driver’s Manual regarding the importance of designating a guardian or person with power of attorney. The legislation will amend Sections 1508 and 7911 of Title 75 (Vehicles) of Pennsylvania Consolidated Statutes. It directs PennDOT to place the following language in both the Driver’s Manual and the Motorcycle Driver’s Manual:

Just as vehicle insurance protects you financially when an accident happens, designating who should serve as a legal guardian, or possess power of attorney, can protect you in the event of a disability that renders you unable to handle your affairs. Doing so now will ensure that your wishes are respected.  Decisions made now will ensure that the people you wish to have control over your affairs in the event of a disability will be appointed to carry out those critical responsibilities.

Please note that the designation of a guardian or granting of power of attorney is not handled through PennDOT. It’s best to discuss the matter with family members before proceeding.

The need for this legislation was brought to my attention when my office received a visit from the family of a man left disabled by a motorcycle accident. He had not designated a guardian, or anyone to possess power of attorney, in the event of a disability. This is common among young people, as most do not yet realize the importance of making these designations before a tragedy strikes. With this legislation, they will be reminded when they access or review a Driver’s Manual or Motorcycle Driver’s Manual.
