Senate of Pennsylvania
Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: March 10, 2022 10:57 AM
From: Senator Joe Pittman
To: All Senate members
Subject: Early Refills of Prescription Eye Drops

In the near future, I plan to introduce legislation that would ensure insurance coverage for early refills of prescription eye drops at 70% of the original prescription.

Many residents in Pennsylvania require prescription eye drops for in-home treatment. When people self-administer eye drops, a certain amount goes unused due to spills or other factors. Currently in Pennsylvania when a person runs out of their prescription eye drops prior to the expiration of the intended period of use and returns to their pharmacist seeking a refill, coverage may be denied. As a result, they are unable to refill their eye drops when needed. This causes people to either ration the remaining medication or go without.

This legislation would bring Pennsylvania in line with guidance from the Centers for Medicare and Medicaid Services (CMS) as well as 29 other states who have passed similar legislation.

I hope you will consider co-sponsoring this important piece of legislation. If you have any questions please feel free to contact Sarah Stauffer, of my staff, at sstauffer@pasen.gov or 717-783-5193.
