Subject: General Assembly Re-Authorization of Emergency Declaration
 
In the near future, we intend to introduce legislation giving the General Assembly the ability to re-authorize an Emergency Declaration implemented by the Governor.

The ongoing COVID-19 pandemic has been a learning experience for every component of state government, including – but not limited to – the executive branch, the legislative branch, and state agencies and departments.

It is our hope that this legislation addresses deficiencies that have resulted in a lack of consultation between the executive and legislative branches.

Our legislation will implement the following re-authorization process:

● After an Emergency Declaration is enacted by the Governor, the General Assembly will reconsider the measure every 10 days.          

● A majority vote by the House and Senate will re-authorize the Emergency Declaration.

● The Emergency Declaration will automatically be rescinded should the General Assembly vote in the negative.

● By taking no action during a 10-day period, the Emergency Declaration will end via default.

Moving forward, this legislation aims to restore checks and balances in our government.
