|In the near future, I intend to introduce legislation that would allow service stations and garages that repair or tow a vehicle to put a lien on the vehicle for lack of payment for services rendered.
Current law allows these facilities to sell “abandoned vehicles” and provides for reissuance of certificates of title. However, it does not specifically address the situation where a service is provided that results in a lack of payment for those services.
My bill will allow a garage or vehicle storage facility to retain possession of a vehicle if repair or storage fees are not paid under certain circumstances. However, it also would place limitations on the ability to retain the vehicles, require notice to consumers at the time of service, and establishes the process for distribution of sales proceeds.
