Subject: Cannabis-Infused Beverages
 
In the near future, I will introduce two pieces of legislation that will amend the Crimes Code and the Liquor Code to safeguard the Commonwealth if any element of cannabis is legalized for purposes other than medical use. My intent is not to promote further expansion of our current laws.

Pennsylvania presently has a three-tier system for the distribution and sale of beer. The existing licensed independent wholesale distribution system is well-trained, efficient, and supports product diversity and consumer choice while serving the public, consumers, and the industry. If there is any further legalization of cannabis, we should build on our existing asset to secure the wholesale distribution of beverage products containing it.

With our beer wholesale distribution system, the public enjoys responsible sales and marketing of an intoxicating beverage, as well as a transparent and accountable chain of custody that protects consumers and allows for immediate recall if necessary. The strict accountability of the system also ensures the collection of all taxes due.

A lesson we have learned from the experiences of other states is that the national and international companies promoting recreational legalization attempt to control the product in a way that best suits them. By ensuring that any changes will be done through our proven wholesale distribution system, Pennsylvania will be best suited to control the process.

I believe this legislation is necessary to channel the debate regarding legalization in a way suitable for Pennsylvania.

Description: The first piece of legislation would amend the Crimes Code to make it unlawful to sell or furnish any cannabis-infused beverages unless they have been distributed through the wholesale distribution system found in Liquor Code Section 431.

Description: The second piece of legislation would amend the Liquor Code to:
  • define “cannabis-infused beverages”; and
  • add “cannabis-infused beverages” to Section 431 and various other sections of the Liquor Code so that wholesale distribution of such products tracks the process for the wholesale distribution of beer.
