Subject: Improvements to DEP's Water Quality Testing Program
 
I am planning to reintroduce legislation (SB 392) to amend Pennsylvania’s Oil and Gas Act (Title 58) with changes suggested in a report by the Auditor General regarding the Department of Environmental Protection’s water quality program (DEP’s Performance in Monitoring Potential Impacts to Water Quality from Shale Gas Development, 2009-2012).

Specifically, my legislation seeks to:
  • Give the department more time to conduct its investigation whenever a suspected water contamination incident involves the migration of natural gas;
  • Require the department to inspect each unconventional well site at least once a year after the well is in production;
  • In addition to wastewater fluids, require the department to maintain records on the generation, transportation, and disposal of drill cuttings;
  • Require the department to publish lists of probably causes of water supply contamination if they are supported by credible evidence; and
  • Require that well inspection reports include the written comments of the inspector as they relate to the well site.
