Subject: Civil Immunity for hospital donations
 
I will be reintroducing Senate Bill 161 of last session, amending the Judicial Code, Title 42 of the Pennsylvania Consolidated Statutes, to provide immunity from civil liability for hospitals that donate for humanitarian aid medical equipment and supplies which are in good condition.

Any act of a donor which constitutes gross negligence, recklessness or intentional misconduct will not be protected.

Today, much of the world’s population lives in poverty, suffering from disease and shortened life-spans. These people need essential medicine, equipment and supplies to survive. Without the donations from our hospitals, more and more people will have no relief from their suffering.

This bill encourages donations by allowing hospitals to donate their supplies without the concern of liability for damages. Hospitals will feel more comfortable donating equipment and people all around the world will be helped by this humanitarian assistance.
