Subject: | Second Class Township Code Amendment--Clarifying what positons a supervisor may hold |
It has been brought to my attention that there is a potential conflict in the Second Class Township Code concerning township supervisors holding other elective or appointive township offices or positions. Section 403, if not in conflict with section 602(c), is at a minimum confusing and has led to suspicion of conflicts. Section 403 stipulates that a township supervisor shall not at the same time hold any other elective or appointive township office or position. It is thought that when this section was written it only addressed elected or appointed positions, and was not in conflict with section 602(c) which allowed supervisors to hold employee positions. As such, I plan to introduce legislation to clarify Section 403 of the Code to stipulate that township supervisors "shall not hold any other elective township office or appointed position in the township that is prohibited by the code or any other state law." |
