Subject: Pennsylvania's Real Estate Licensing and Registration Act (SB 991)
 

Based on numerous constituent calls concerning the behavior of pipeline land agents, I have introduced Senate Bill 991 to amend Pennsylvania's Real Estate Licensing and Registration Act. The bill provides for the regulation of land agents through the following:

Defines Land Acquisition Broker as:

  • A person who acquires or manages oil, gas or mineral interests.
  • Performs title or contract functions related to the exploration, exploitation or disposition of oil, gas or mineral rights.
  • Negotiates for the acquisition or divestiture of oil, gas or other natural resources, including the acquisition or divestiture of land or oil, gas or mineral gas rights for a pipeline.
  • Negotiates business agreements that provided for the exploration for or development of oil, gas or minerals.

Requires Registration with the Pennsylvania Real Estate Commission, allowing for public access to a listing of registered agents

Requires criminal history background checks of brokers and provides the Commission with authority to revoke or suspend them for a number of reasons such as fraud or misrepresentation.
