Senate of Pennsylvania
Session of 2015 - 2016 Regular Session

MEMORANDUM

Posted: December 4, 2015 12:25 PM
From: Senator John N. Wozniak
To: All Senate members
Subject: Trial for Certain Criminal Offenses Involving Firearms

In the near future I will be introducing legislation that will require a trial by jury for anybody charged with a drug offense involving a firearm or replica of a firearm; even if the firearm wasn't used.

The Attorney General or district attorney prosecuting the offense will be prohibited from entering any plea agreement or any other agreement with the person charged that would otherwise exempt them from sentencing mandated under Section 9712 of Title 42. In addition, any person charged with such an offense involving a firearm or replica of a firearm may not be subject to any trial other than a trial by jury.

Please join me in co-sponsoring this important legislation. If you have questions about the legislation, please contact my office at 717-787-5400.

Introduced as SB1298
