Senate of Pennsylvania
Session of 2015 - 2016 Regular Session

MEMORANDUM

To: All Senate members
Subject: Protection for Unpaid Child Support Legislation

In the near future, I plan on introducing legislation to protect families who are owed unpaid child support. This legislation is similar to Senate Bill 919 from last session. There are some distinct differences however.

This bill would provide open communication between Pennsylvania gaming facilities and the PA State Police. Currently, when a person wins more than $1200 at a casino, that individual is required to fill out paperwork for the Internal Revenue Service. During that time, the PSP conducts a background check to see if that person has any outstanding warrants against them. The check is done internally and takes less than two minutes.

My legislation would allow the PSP to search for any bench warrants due to unpaid child support. In the event that a winner has a warrant out for unpaid child support, the Dept of Revenue would be notified by the PSP. The gaming winnings in these circumstances would be garnished so that back child support can be paid.

This legislation has undergone various changes from Senate Bill 919 of last session. Both the Pennsylvania State Police, The PA Gaming Control Board and the Department of Revenue provided helpful information as to how this can run efficiently and use full discretion.

Please join me in support of this legislation to protect those who are owed unpaid child support. If you have any additional questions, please contact Jason Gerard in my Harrisburg office. Thank you.
