|Please join me in sponsoring legislation introduced as Senate Bill 596 in the 2011-2012 legislative session by Senators COSTA, YUDICHAK, ERICKSON, TARTAGLIONE, FONTANA, KASUNIC, LEACH, FERLO, BREWSTER and BROWNE.
The legislation establishes a fund to provide for well water testing and clean water for residents or businesses that have reason to expect that Marcellus Shale drilling activity may have contaminated their well water. The fund would pay for a test of the water by DEP. If DEP finds that any contamination poses a health hazard and is likely to be caused by drilling activity, the fund may be used to provide clean water until a final determination is made. The Fund would determine either the contamination was not due to drilling activity or that the contamination was due to drilling activity and the actual responsible party begins to pay for a replacement water supply.
The fund would receive its money from a $10 surcharge applied to the drilling permit. There is a cap of $20,000 on the size of the fund and once that is reached DEP is to remove the surcharge.
