Subject: | Continuing Pennsylvania Horse Racing by Extension of Regulations |
The Federal Horseracing Integrity and Safety Act of 2020 regulates thoroughbred racing throughout the United States and overrules state laws about certain aspects of horse racing. However, the enforcement of this act has been delayed by ongoing litigation challenging the constitutionality of the act. In this regulatory twilight zone, Pennsylvania’s Horse Racing Commission has performed the role of protecting and regulating horse racing in the Commonwealth through temporary rules that are currently set to expire October 19, 2025, and by current law cannot be extended. This makes for something of a legislative emergency, because it is unlikely that the federal laws will be fully effective by that date, and the formal regulatory process needed to make the Commission's temporary rules permanent will take longer. To address this, I will soon introduce legislation to allow the Commission an additional extension until October 2028 to convert temporary regulations to permanent regulations.
