Under current law in Pennsylvania, tenants are not permitted to remain in a rental property while property violations are being corrected. As a result, undue stress is placed on tenants as they are tasked with finding alternative housing during repairs. For this reason, I will be introducing legislation that would permit tenants who are currently residing in a property to remain in the property, dependent on the property’s safety and habitability and approval of the municipal code enforcement officer. These tenants may also withhold rent pursuant to the City Rent Withholding Act. However, new occupants would be prevented from moving into a property while the property has a temporary access certificate and is undergoing repairs. It is vital that the practical application of access permits in our local municipalities are addressed. Please join me in co-sponsoring this important legislation. |
