Subject: Medical Cannabis Administered by School Nurses
 
Currently, guidance from the Department of Education determines how school districts should respond to students who need medical marijuana during the school day. PDE guidance states that a parent, guardian or caregiver should be permitted to administer medical marijuana to their child on school grounds, and must remove any excess medical marijuana from the school premises after administration. While this guidance is aimed at preserving student and staff safety, it unfortunately places an additional burden on parents, guardians or other caregivers. These individuals must already balance jobs and other obligations with caring for their ailing child, and may not be able to get out of work to drive to their child’s school and give them the medicine upon which they rely.
 
It is for this reason that I will be introducing legislation to permit a school nurse to act as a secondary caregiver for a child, which will allow the school nurse to administer medical marijuana to the child. The legislation also waives the $50 caregiver fee for school nurses. It is my hope that my legislation will make it easier for children to get life-improving medicine while they are at school.
