Subject: | Protecting Residents of Medical Facilities |
A disparity in state law grants sovereign immunity to medical facilities run by local governments, while excluding state-run and private facilities from these same immunity protections. Because of this, residents at a hospital or nursing home run by a local government cannot sue that facility for medical professional liability, while residents at state-run facilities or privately-owned facilities can. This creates an unfair legal framework where residents at certain facilities have fewer rights and protections than others in similar circumstances. I am introducing a bill to correct this imbalance. My legislation creates a new exception from sovereign immunity and imposes medical-professional liability on municipalities. This will allow residents at medical facilities run by local governments to have the same rights to sue for violations as residents at state-run and private facilities. This is an important step forward for government accountability and will ensure that residents can seek financial compensation for damages caused by local healthcare professionals.
