Subject: Reclaiming the General Assembly’s oversight authority over the rulemaking process (Former HB 2649)
 
Please join me as a co-sponsor of legislation to reclaim the General Assembly’s oversight authority over the rulemaking process.

The Independent Regulatory Review Commission (IRRC) is composed of five members, with the speaker, president pro tempore, the two minority leaders, and the governor making an appointment. This legislation would add two appointments from the two majority leaders.

Currently, IRRC has no power under the Regulatory Review Act (Act 181 of 1982) to bar the publication of a proposed regulation if it does not meet the requirements of the statute. This legislation would give meaning to the IRRC disapproval process by barring an agency from promulgating a final-form or final-omitted regulation that is disapproved.

Since the ability for agencies to promulgate regulations invariably comes from a statute enacted by the General Assembly, it makes sense for the General Assembly to ensure that proposed regulations comply with the intent of the Legislature.
