Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: June 10, 2022 10:24 AM
From: Representative Malcolm Kenyatta and Rep. Christopher M. Rabb
To: All House members
Subject: Sedition-Free Pennsylvania

Democracy is a fragile thing, and we must do everything in our power to protect it for ourselves and our posterity.  In the recent past, our democracy was threatened by a group of armed individuals.  It continues to be threatened by individuals who share misinformation and create distrust, fear, and ignorance within our communities.  Some individuals spread deceit and encourage upheaval while holding elected office.  Sedition should have no place in Pennsylvania, nor should public servants be permitted to continue in their elected office if they commit sedition against our nation.

For these reasons, we plan to introduce two pieces of legislation seeking to eliminate sedition in our great state and ensure that our elected officials are held accountable for actions they take against our democracy.  Please join us in co-sponsoring these safeguards of democracy.  Your consideration is greatly appreciated.

Document #1

Introduced as HB2762

Description: The first piece of legislation is a joint resolution proposing an amendment to the Constitution of Pennsylvania.  It would provide that no person convicted of seditious conspiracy against the United States be eligible for elected office in Pennsylvania.  It would further remove civil officers from their offices upon conviction of seditious conspiracy against the United States.

Document #2

Introduced as HB2763

Description: The second piece of legislation would create new offenses and assess penalties under Title 18 (Crimes and Offenses) of the Pennsylvania Consolidated Statutes for seditious conspiracy against the Commonwealth.
