MEMORANDUM

Posted: May 10, 2022 02:52 PM
From: Representative Anthony M. DeLuca
To: All House members
Subject: Addressing Penalties for PFA Violations

In the near future, I intend to introduce legislation to strengthen penalties for those individuals who violate a Protection From Abuse order (PFA). Current law allows for a $300-$1,000 fine in addition to up to 6 months of imprisonment or up to 6 months of supervised probation. I believe probation should not be an option in these cases, and under my legislation it would be eliminated.

I have read alarming reports in recent years of individuals violating PFAs over and over, and in other cases violating the PFA and committing acts of violence shortly after. These cases often lead constituents to ask, “why can’t our state government protect these victims?” Abusers who violate a PFA are a danger to those under the order’s protection, and we must not allow them to commit further violations or acts of violence.

Please join me in co-sponsoring this important legislation to keep vulnerable individuals safe from abuse.
