Subject: Use of Wireless Communication Devices While Dispensing Fuel
 
According to the National Fire Protection Association, local fire departments respond to more than 4,000 fires at gas and service stations each year. These fires cause an average of 43 civilian fire injuries and $30 million in direct property damage annually. The risk of spilling highly flammable liquid fuel is higher when the person fueling is distracted. Understandably, using a cell phone while fueling up a car creates a distraction that endangers the fueler and others around them.

In an effort to prevent avoidable fires and explosions in these circumstances, I am proposing legislation to make the use of a wireless communication device while dispensing a liquid fuel a summary offense. Fuel dealers must post signs informing customers of this policy on their property. Those who fail to do so will face a civil penalty established by the State Fire Commissioner.

Ensuring individuals remain alert and undistracted while fueling their vehicle can save lives and avert thousands of dollars in property damage. Please consider supporting this proposal designed to improve public safety in gas stations.
