| Subject: | Small Business Enterprises Legislation |
| Currently Pennsylvania’s small businesses designated as Small Business Enterprises (SBE) within the Commonwealth must maintain certain requirements in order to maintain their certification. SBEs must be a for profit, United States business, and be independently owned. The business may not be dominant in its field of operation, may not exceed a three- year average gross revenue of $38.5 Million (regardless of business type) and may not employ more than 100 full-time equivalent employees. Businesses certified as SBE by the Department of General Services (DGS) have the opportunity to compete for small business contracting opportunities with the state and thus provide employment for many Pennsylvanians, including many veterans. The current law is so specific that it leaves out many businesses that meet all the criteria but are “people intensive” meaning that they exceed the 100 full-time equivalent employee threshold. SBEs in the contact center industry are specifically concerned that as they grow, this limitation will restrict their ability to maintain their SBE certification and will force them to move their headquarters out of Pennsylvania. It is with this in mind that I will soon introduce legislation to allow DGS to set the employee threshold to qualify as a small business enterprise. By allowing DGS to determine this threshold, we can ensure that all small businesses, no matter the industry, can compete equally for small business contracting opportunities and keep employment opportunities in PA.
