In the near future, I will be re-introducing legislation – former House Bill 958 of 2017-2018 – to amend the Landlord and Tenant Act by requiring landlords to provide a certified copy of foreclosure notices to all tenants of a property. My proposal inserts the Tenants’ Right to Disclosure into the Landlord and Tenant Act of 1951 to compel landlords to provide fixed-term tenants with a certified copy of a foreclosure notice at least 60 days prior to the termination date specified in the notification. In addition, landlords must provide month-to-month and week-to-week tenants with certified documentation at least 30 days prior to the termination date. Currently, landlords are not required to provide notice to tenants when a foreclosure notice has been delivered to the property owner. As a result, tenants are forced to remove their personal property and relocate to a new residence at the time of the foreclosure without adequate time to make arrangements. This experience can be overwhelming for individuals and families, and result in long-term financial hardship and emotional distress. It is our duty, as public servants, to protect renters, especially our most vulnerable populations, from this difficult-and sometimes traumatic experience. Please join me in cosponsoring this legislation to ensure that tenants, in the event of foreclosure, have proper notice from their landlords and are protected from undue hardship. |
