Subject: Temporary & Standby Guardianship Clarification
 
In the near future, I plan to introduce legislation to clarify a small point in temporary and standby guardianship cases involving minor children.
 
My legislation states that if dependency proceedings involving the child have been initiated, a parent or other legal custodian of the child may not thereafter designate a standby or temporary guardian for the child. The purpose of the legislation is to ensure that there will not be parallel proceedings or processes to determine custody of the same child, and is consistent with a similar provision in the child custody law.  
 
This legislation was requested by the Administrative Office of Pennsylvania Courts (AOPC) in order to correct an oversight which came to light after passage of the Temporary Guardianship Law in 2018.
