Subject: Penalizing Those Employing Undocumented Workers

Over the past few months, we have witnessed the dramatic attempt of people seeking access at our borders. Many of them are seeking a better life for themselves and their families, which is understandable. However, we should do what we can to encourage them to enter the country legally.

If undocumented individuals can easily find work once across the border, it is an obvious incentive to enter under any means necessary.

If those employment opportunities go away it is reasonable to assume that workers would be less inclined to enter illegally. Businesses should not feel comfortable using undocumented workers. This seems to be an obvious loophole.

My proposal would amend Title 18 (Crimes and Offenses) to penalize businesses for employing undocumented workers. Any employer found to employ or to have employed an undocumented worker will be subject to the suspension or revocation of their professional or business license by the applicable authority or agency and also be fined $5,000.

Last session this was HB 727.

I invite you to join me as a cosponsor of this legislation. Thank you.
