Subject: Medical Cannabis Law Revisions (Prior HB 2945)
 
Following the passage of legislation legalizing medical cannabis in 2016, the legislature directed the Dept. of Health to perform a two-year review of the program and to provide the General Assembly with any necessary recommendations.  The Dept. of Health issued its report (attached) and has asked the General Assembly to advance certain revisions to the law.

In the near future, I intend to reintroduce legislation to revise the medical cannabis law by the adoption of three of the recommendations offered in the Dept. of Health’s report.  The three revisions included in the proposed legislation are as follows:
 
  1. Changes in federal schedule classification by the FDA will not impact the ability of dispensaries to continue to dispense medical cannabis under the provisions of Pennsylvania law.
  2. The definition of “caregiver” will be revised so as to include long-term care facilities, e.g., nursing homes, and the background check system will be modernized to better facilitate background checks for caregivers and industry workers.
  3. Dispensaries will be able to provide limited on-site outdoor pickup, expanded caregiving, remote consultations and medical dosages for no more than 90 days supply. The changes under this no. 3 are already in place under the Governor’s emergency order, this legislation will codify these changes.
This bill does not legalize or promote the use of recreational marijuana, and decisions regarding the issuance of additional licenses would remain exclusively with the legislature.
