Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: December 11, 2020 12:52 PM
From: Representative Daryl D. Metcalfe
To: All House members
Subject: Governor Wolf Impeachment Resolution

Gov. Wolf's recently announced orders in response to the COVID-19 outbreak, and his orders from earlier in 2020, have violated a number of our God-given rights affirmed in the United States Constitution. In particular, his orders mandating the closure of physical locations of all businesses have violated our citizens’ rights in devastating ways.

His most recent unconstitutional order announced on December 10th mandates the end of indoor dining, gathering size limits of 10 people indoors and 50 people outdoors, 50% capacity limits for in-person businesses, the closure of gyms and fitness centers, the closure of businesses in the entertainment industry, and the end of youth and school sports and extracurricular activities.

It is unconscionable that the Governor would make this decision approaching the holiday season. His action means that businesses throughout the state will be forced to lay off their employees, our constituents, who were depending on having a source of income throughout December and into the New Year. The holiday season is particularly important for many of these businesses, likely meaning that thousands of businesses closing to comply with the order will never reopen as a result of the revenue they will miss out on throughout the holidays.

His lack of transparency in creating and announcing his orders is particularly troubling. The Governor's recent order has given businesses throughout the state no time to plan for the closures, only exacerbating the damage it will do to businesses and their employees.

As Gov. Wolf continues to violate so many of our fundamental rights as citizens of the Commonwealth, I will be introducing a resolution impeaching the governor and exhibiting Articles of Impeachment to the Senate. His actions plainly constitute the misbehavior in office required for his impeachment under the Pennsylvania Constitution.

While these are certainly challenging times, Gov. Wolf must be held accountable for his actions that have harmed so many of our citizens and violated so many of our rights. No individual or office is above the law.
