Subject: Accelerated Rehabilitative Disposition - Expungement
 
One of the most important decisions that a working parent has to make is who to trust to watch over their children. Unfortunately, Accelerated Rehabilitative Disposition (ARD) can enable criminals who commit a crime in the presence of a child to have their record expunged, preventing parents from making an informed decision about their child’s caretaker.

My legislation will delay expungement by five years for individuals who have received ARD for any offense that was committed in the presence of a child under the age of 14. Such individuals may still participate in the ARD program, but the five year time period prior to expungement of the offense will ensure that parents and childcare providers can fully analyze a person’s background before entrusting him or her to watch over a child.
