Subject: Home Owners Associations Disclosure
 
Nearly one quarter of Pennsylvania residents live in self-governing Common Interest Owned communities (CIOC), which include condominiums, cooperatives, and planned communities. Many are typically governed by Home Owners Associations (HOAs) which are professionally managed. Others are self-governed by residents.

The Uniform Condominium Act Title 68 which governs the creation, management, and regulation of all condominium developments in the state of Pennsylvania is very specific about the rights and responsibilities of homeowners and management in CIOCs.

In the near future I plan to introduce legislation that would require a seller or the declarant in the CIOC to disclose whether or not the CIOC follows the provisions of Title 68 so that prospective buyers can understand if and how the statute will affect them in their community, and the limitations of state oversight before they purchase in the community.
