MEMORANDUM

Posted: November 13, 2020 01:47 PM
From: Representative Gary Day
To: All House members
Subject: Election Fraud Witness Immunity

Members, in the very near future I intend to introduce legislation designed to uncover the truth of what happened in this past general election.  Law enforcement and prosecutors often use grants of immunity to encourage people with knowledge of criminal activity to help expose more widespread crimes.  Given safety from prosecution or lawsuits, perhaps someone who saw, knows about, or even participated in election fraud would be willing to come forward and shine light on the truth.

I propose we enact a law granting immunity for this purpose to anyone who reports election fraud, cooperates in an investigation of election fraud, or testifies about election fraud.  Although prosecutors use the grant of immunity for individuals through use of their discretion, the General Assembly speaks through legislation.  For that reason, I believe this bill is necessary to show how highly we value the importance of revealing such attacks on the base of democracy.
